You further acknowledge and agree that the Confidential Information received or obtained through the use of this Website shall be held in strict confidence and you shall use all reasonable steps to safeguard the Confidential Information from disclosure. The Confidential Information shall not be disclosed, reproduced or shared by any means with any other person, corporation, partnership or other third party including other members of Fishing Lake First Nation.  You specifically acknowledge and agree that you will not, directly or indirectly, sell, assign, distribute, provide access to, transmit, exploit, copy, modify, publish, republish, reproduce, repackage, retransmit, recompile, decompile, disassemble, reverse engineer or otherwise disseminate the Confidential Information or any portion thereof, in any medium or in any manner whatsoever; and you will not use the Confidential Information to construct a database of any kind, nor store the Confidential Information (in whole or in part) in databases for access by you or any third party, nor distribute any database services containing all or part of the Confidential Information.  You further agree that you will not share with any other person and will keep your Log In Credentials confidential and secure.

No representation or warranty, express or implied, is provided in relation to the fairness, accuracy, correctness, completeness or reliability of the Confidential Information contained on the Website and the Confidential Information is made available to you solely for the Purpose. You agree that you will not use the Confidential Information in any way that may damage the reputation, business interests and activities of the Trust. You further acknowledge and agree that you are authorized to view the Confidential Information for your own personal information only. You agree and acknowledge that you may rely on the Confidential Information solely at your own risk, and that the Trust will not be liable for any damage, loss, or other injury arising from reliance on the Confidential Information. 

In the event of a breach of obligations of confidentiality contained in these Terms of Use, you agree that in addition to any other remedy the Trust may have, you:

  • shall be liable for all direct and indirect losses, loss of profits, loss of opportunities, costs damages and expenses whatsoever, including any legal fees, which the Trust may suffer, sustain, pay or incur;
  • shall indemnify the Trust against all actions proceedings, claims, demands, loss, costs, legal fees, damages and expenses whatsoever which may be brought against or suffered by the Trust for whatever reason; and
  • hereby agree that the Trust will be irreparably harmed by a breach of the obligations of confidentiality contained in these Terms of Use and such harm may not be adequately compensated for by damages. As such, the Trust, by and through its Trustees, shall be entitled to equitable relief, including temporary and/or permanent injunctive relief and specific performance in addition to all other remedies available at law or in equity. This right shall not be construed so as to prevent the Trust, by and through its Trustees, from pursuing, either consecutively or concurrently, any and all other legal or equitable remedies available for such violation.

You acknowledge and agree that the obligations of confidentiality contained in these Terms of Use are reasonable and valid in order to protect the legitimate business interests of the Trust and, as such, you waive all defences to the strict enforcement of the obligations in these Terms of Use.
